Out of the 50 Democratic senators in office at the time, fforty-one Democrat senators voted in favor of H.R. 5005 (the Homeland Security Act of 2002) on November 19, 2002, which created the Department of Homeland Security and established Immigration and Customs Enforcement (ICE). Out of the 50 Republican senators in office, 48 Republican senators and 1 Independent voted in favor of H.R. 5005. Only 9 senators voted against the bill in total (8 Democrats and 1 Independent). One senator did not vote.
