The Hind Rajab Foundation and the Center for Constitutional Rights had actively filed complaints with the U.S. Department of Justice and the New York State Attorney General’s office requesting his arrest upon entry. His ministry ultimately decided not to send a delegation to the United Nations Chiefs of Police Summit.

Because war criminal, zionist Itamar Ben-Gvir wws not in New York City, demonstrations, such as the one at Dag Hammarskjöld Plaza by the Palestinian Youth Movement, pivoted focus to broader advocacy.

And we will not stop at Ben Gvir. No war criminal is welcome in NYC, and we will meet any and all of them with just as much anger and organization.

As we rally, we reaffirm that we will never abandon Palestine. Israel is still committing genocide in Gaza, families are still being displaced and dispossessed in the West Bank, and our prisoners are still being tortured in Ben Gvir’s prisons. We will continue to confront Zionism and genocide in every form it takes in our city, be it in the form of war criminals or the sale of stolen Land.

Ben-Gvir cancels New York visit after the Hind Rajab Foundation and Center for Constitutional Rights legal action: A significant victory!

Press release by the Hind Rajab Foundation: “4 July 2026, New York, United States – The Hind Rajab Foundation (HRF) welcomes reports that Israeli National Security Minister Itamar Ben-Gvir has canceled a planned visit to New York following calls for his prosecution initiated by our organization and the Center for Constitutional Rights, in addition to pressure mounted by grassroots mobilization organized by the Palestinian Youth Movement and others.

According to reports by several media outlets, Ben-Gvir’s decision came after HRF filed a complaint with the United States Department of Justice and, together with the Center for Constitutional Rights, submitted a letter urging New York Attorney General Letitia James to launch an investigation into Ben-Gvir’s violations of New York State law and his crimes against New York residents.

HRF and the Center for Constitutional Righs have also called on Attorney General James to establish a dedicated Atrocity Crimes Accountability Task Force within the Office of the Attorney General. This task force should investigate all atrocity crimes perpetrated by or against New York residents in the Occupied Palestinian Territory, irrespective of the identity or nationality of those responsible.

This is a significant and concrete victory.

No Safe Haven

For decades, Israeli political and military leaders have traveled the world with the expectation of impunity. That era is coming to an end. The growing prospect of legal accountability is already impacting their freedom of movement. When an Israeli minister cancels an international trip because of the possibility of facing criminal investigation, it demonstrates that accountability efforts are producing tangible results.

The message is clear: those suspected of involvement in atrocities and war crimes can no longer assume they can travel abroad without legal risk.

Nevertheless, Ben-Gvir’s decision to stay away from New York does not satisfy the pursuit of justice. It merely delays legal questions that demand resolution.

The Duty to Investigate Remains Unchanged

The responsibility of the New York Attorney General remains in force whether or not the subject of the complaint has chosen to enter the state’s jurisdiction. Attorney General James continues to have a duty to meet with New York residents who are victims of the crimes described in our submission and to thoroughly investigate the allegations presented.

Investigations should not be deferred until after a suspect enters the jurisdiction. They must be undertaken in advance to ensure that, if Ben-Gvir or any similarly situated individual enters New York, the authorities are in a position to act immediately.

More fundamentally, this case has never been solely about Itamar Ben-Gvir. He may oversee the Israel Prison Services’ policy of torture, but that torture is carried out by individual guards and prison workers. Ben-Gvir may have filmed himself abusing activists from the Global Sumud Flotillas, but these activists were also kidnapped, illegally detained, and tortured by individual Israeli soldiers and police. Ben Gvir may champion and distribute weapons to the illegal settler movement, but it is the settlers and the soldiers protecting them who carry out Israel’s policies of apartheid and violent dispossession on the ground.

There are New York residents who have participated in atrocity crimes in the Occupied Palestinian Territory. There are also New York residents who are victims of those same crimes or who have lost family members, loved ones, or property as a result. These connections create both a legal basis and a moral imperative for state authorities to investigate.

Our Legal Demands Remain Unchanged

No New York resident should be forced to live alongside individuals responsible for genocide, crimes against humanity, or war crimes. Accountability is not only about punishment; it is about protecting communities, upholding the rule of law, and ensuring that no jurisdiction becomes a safe haven for perpetrators of the gravest international crimes.

The cancellation of Ben-Gvir’s trip marks an important milestone, but it is only one step in a much broader effort to enforce accountability.

Every legal filing erodes the wall of impunity. Every investigation strengthens the rule of law and expands the reach of accountability. Every canceled trip demonstrates that accountability is no longer theoretical but carries real-world consequences long before the first day in court.

The Hind Rajab Foundation will continue pursuing this strategy of offensive legal action wherever international and domestic law provide avenues for justice.

This victory deserves recognition.

But, our work continues.”

Groups call on New York Attorney General Letitia James to investigate Israeli Minister of National Security Itamar Ben-Gvir in advance of July 8, 2026, visit.

Letter urges Letitia James to meet with New York victims

Press release by the Center for Constitutional Rights: “July 2, 2026, New York – In light of consistent inaction from the U.S. Department of Justice with respect to The Hind Rajab Foundation’s urgent request for prosecution of Israeli Minister of National Security Itamar Ben-Gvir, the HRF and the Center for Constitutional Rights have submitted a letter to New York Attorney General Letitia James to urge her to meet with New York victims of Ben-Gvir’s crimes and initiate an investigation of Ben-Gvir under New York State criminal law in anticipation of his visit to New York City on July 7-8. 

The letter argues that because a number of New York residents have been harmed by Ben-Gvir’s criminal conduct and because Ben-Gvir may also be engaging in criminal conduct while in New York, Attorney General James has the authority and the obligation to commence a criminal investigation into Ben-Gvir. 

Specifically, the letter cites: 

  1. Torture and abuse by the Israeli Prison Service (IPS) under Ben-Gvir’s authority against New York residents, including one Palestinian American subjected to starvation and other torture methods while detained in an Israeli prison, and ten participants in the 2025 and 2026 Global Sumud Flotillas, who were subjected to torture and abuse, both directly by Ben-Gvir and by officers operating under his authority, after they were illegally detained in international waters.  
  2. Ben-Gvir’s distribution of gun permits and weapons to Israeli settlers in the Occupied West Bank in furtherance of Israel’s policies of apartheid and violent dispossession. 
  3. Ben-Gvir’s direct incitement to genocide, which has resulted in concrete genocidal actions against Palestinians within the IPS, Gaza, and the Occupied West Bank. 

The letter further argues that, given Ben-Gvir’s actions in these three areas of responsibility, there are reasonable grounds to believe that he has committed at least nine different crimes under the New York Penal Code. 

The Hind Rajab Foundation and the Center for Constitutional Rights have further urged Attorney General James to: 

  • Convene and lead an interdivisional effort to identify New York residents that actively served in the Israeli armed forces since October 7, 2023, identify the perpetrators of Israeli atrocity crimes and assess those crimes’ impact on New York residents;
  • Establish an Atrocity Crimes Accountability Task Force in the Criminal Justice Division responsible for investigating atrocity crimes  perpetrated by or against New York residents in Gaza or the occupied West Bank.

The HRF and the Center for Constitutional Rights expressed their willingness to facilitate this process and reiterated their commitment to holding Ben-Gvir accountable for his crimes and to bringing justice to the victims. 

Jake Romm, the HRF’s representative in the U.S., stated, “Since the beginning of the present genocide, the U.S. Department of Justice has met our requests for prosecution with consistent silence and inaction in direct contravention of the U.S.’s international and domestic legal obligations. If the federal government is going to continue to deny justice for victims of Israeli atrocities—even when those victims are U.S. nationals—then it is up to U.S. states to provide their own avenues for accountability instead.”

“Itamar Ben-Gvir is a far-right, ultranationalist Israeli politician and hardline Israeli settlement leader who serves in the Israeli cabinet, brashly resorting to extreme racist rhetoric, glorification of violence, and incitement,” said Brad Parker, Associate Director of Policy at the Center for Constitutional Rights. “Ben-Gvir’s actions amount to atrocity crimes against Palestinians, for which Israeli officials like Ben-Gvir enjoy near complete impunity. When Trump is complicit and works to foster that impunity, it is imperative that New York State officials act to challenge it.”

Itamar Ben Gvir is one of the principal architects and promoters of the ongoing genocide, war crimes, and crimes against humanity committed against the Palestinian people. The harm that he has caused extends beyond Palestine and has directly impacted New Yorkers. Attorney General James now has the opportunity—and obligation—to ensure that New York does not become a safe haven for perpetrators of grave atrocity crimes.”
